Now the plan finds itself under the scrutiny of the Economist who has opined from the start that nationalization was not the proper solution. Northern Rock would remain nationalized until the current financial climate improves.

Gender difference Essay The article I read is â€Å"‘Health is not a man’s domain’: lay accounts of gender difference in life-expectancy in Russia†. The authors, Ilkka Pietila and Marja Rytkonen, examined the meaning of health to Russian lay people, conducting interview with 29 people aged 15-81. They concluded that the role of the individual in healthy responsibility is very weak, with a stronger emphasis on societal and governmental influence. They also found that in relation to gender, gender roles and relations are static with few alternatives despite social changes. This study was prompted by the large gender gap in life-expectancy in Russia. In 2006, the average life expectancy was 59 years for Russian men but 72 years for Russian women. Pietila and Rytkonen wanted to see if this gap was caused by gender perceptions of health and/or each other or by something else. The theoretical basis for this research is a process Frankel and Davison call ‘lay epidemiology’, which states that â€Å"individuals interpret health risks through the routine observation and discussion of cases of illness and death in personal networks and the public arena, as well as from formal and informal evidence arising from other sources, such as television and magazines (p. 071). The researchers discerned â€Å"four types of explanations: essential/naturalist explanations (biological and psychological differences), explanations related to social roles, explanations related to social change and explanations related to health behavior† (p. 1075). They also found that these explanations often centered around one health behavior: heavy drinking. This article is a great because of its discussion the masculinity behind drinking, as well as the cultural aspects yet how the women tended to see drinking as more of a health hazard then the men who participate in it. The phenomenon of the gender gap and the cultural aspects of drinking add unique curveballs to solving the health crisis in Russia today. An article like this one is very important because it illustrates factors that need to be considered when coming up with a public health policy for Russia. For example, this findings of this research would support the argument that prohibition would not work in reducing alcoholism in Russia; alcohol’s cultural significance is too strong for such a policy to have any ‘lay’ support. The article also noted its limitations. The authors only interviewed subjects in St. Petersburg, which is one of the more Westernized cities in Russia and is more likely to have an higher educated and socioeconomic population compared with the majority of Russia. The authors conceded that this population dynamic may have skewed the results. They also admit that their research sample was small (only 29 people interviewed), although they did their best to have a variety of ages and occupations within these people. One excellent point in the researcher’s methodology is the use of native-Russian speakers to conduct the interviews, and having men interview men and women interview women. The use of native speakers would allow for the nuances of language and communication to be picked up. The gender separation also nullifies the possibility that gender biases would have taken place during the interviews.

hiroshima :: essays research papers

Hiroshima traces the experiences of six people who survived the atomic blast of August 6, 1945 at 8:15 am. The six people vary in age, education, financial status and employment. Miss Toshiko Sasaki, a personnel clerk; Dr. Masakazu Fuji, a physician; Mrs. Hatsuyo Nakamura, a tailor's widow with three small children; Father Wilhelm Kleinsorge, a German missionary priest; Dr. Terufumi Sasaki, and the Reverend Kiyoshi Tanimoto are the six Hersey chose from dozens of people he interviewed. The book opens with what each person was doing moments before the blast and follows their next few hours, continuing through the next several days and then ending with their situation a year later. In the opening chapter, "A Noiseless Flash" he gives short scenarios of what each was doing moments before the blast and immediately after. At one point during the blast Dr. Sasaki says â€Å"Sasaki gambare!† which means be brave in English. The second chapter, "The Fire," picks up with each victim as they begin to realize their surroundings. All face a different sort of horror as they realize their lives have been spared yet the world as they knew it is gone. A quote by Miss Sasaki kind of sums up with this chapter is all about â€Å"I am lying here and I can’t move. My left leg is cut off.† "Details Are Being Investigated" is the title of the third chapter and as the title suggests, the people of Hiroshima are being bombarded with rumors about the bomb and eagerly await any official word. Information is scarce and the phrase "details are being investigated" is repeated throughout the city over word of mouth and other ways of communication. This chapter is the longest and talks about what is happening to the six as the day passes into night. At first I was confused by the title of the fourth chapter: "Panic Grass and Feverfew." But I later realized it was talking about the effect the bomb had on the growth of the wild flowers and plants around Hiroshima. Two of these plants that grew a lot around the ruins of the city were panic grass and Feverfew.

The Onion Rhetorical

With the use of criticism, this press release is used to satirize how advertisement is degrading to Americans, and to mock the ordeal methods used by marketers to sell products to consumers as absurd. By using obvious fictional fads, and somewhat surprisingly effective persuasive writing skills, this article is humorous and completely irrelevant. However with the correct use of persuasive writing techniques, mixed with irrelevant, and unrealistic factual information the authors create a humorous satirical scene.The mocking starts right away in the first paragraph of the piece. The first sentence â€Å"stressed and sore-footed Americans everywhere† starts off the first part of hyperbole with the word â€Å"Everywhere† indicating that they are exaggerating how many American’s have sore feet for not EVERY American has a sore foot. It provides the reader a sense of exaggeration in the piece. In attempt to establish the need the authors use â€Å"Americans everywhere are clamoring for the exciting new MagnaSoles..† This provides the audience with the fact Americans are too caught up with having the new latest item.Next the author uses the diction choices â€Å"stimulate† and â€Å"soothe† to describe the action the magnaSoles will have on the wearer’s feet. This gives an irrelevant outcome for the words stimulate and soothe are not related at all and have different definitions. Towards the end of the paragraph the authors use unrealistic diction choices and sarcasm to make their claim. The word â€Å"Pseudoscience† is used to describe the type of â€Å"5 forms† of science used to make the MagnaSoles. The authors use the word â€Å"pseudoscience† for the word â€Å"Pseudo† means fake, allowing the reader to see that they are talking about fake science.They do this in hopes to have the readers think on the advertisements they watch and how much of the information on those advertisements are a ccurate and true. The authors used â€Å"which stimulate an soothe the wearers feet using no fewer than five forms of pseudoscience† as a form of paradox to help support the idea that they are creating for the audience.The purpose changes throughout the piece. The second paragraph changes purpose compared to paragraph one. In the next few sections/paragraphs the writers are mocking the archetypal use of â€Å"Expert† testimony to authority to  convince consumers of the inaccurately fictional product. The first Rhetorical device used is Testimony to authority, starting with the first sentence. They use â€Å"expert† quotes from the made up Dr. Bluni.The doctor tries to explain how different the insoles are by stating â€Å"what makes MagnaSoles different†¦Ã¢â‚¬  Then as he continues the author uses sarcasm by stating â€Å"harnesses the power of magnetism to property align the bio magnetic field around your foot.† The author uses these inaccurate and fictional â€Å"smart words† to show the audience the illogical information used on today’s advertisements is believed by such gullible consumers. As the second paragraph goes on the authors are in hopes to convince their audience to realize that they believe in whatever someone says as long as they are using bold words.In order to do this the writes use another diction choice â€Å"isometrically† which is a made up fiction word. As the piece progresses on the authors use sarcasm to convince the readers that consumers’ are believable to marketers as long as they are using â€Å"scientific-sounding literature†.The authors do so by adding â€Å"according to the scientific- sounding literature trumpeting the new insoles†. Another piece of sarcasm and paradox used in this paragraph to again show the guillableness of the consumers and stupidity of the advertisements in today’s era is â€Å"reflexology.. Establishes correspondence betw een every point on the human foot and another between of the body..†The diction â€Å"Reflexology† is another fictional word the author uses to show how gullible the audience is because it sounds scientific so â€Å"it must be true†. â€Å"Correspondence between every point on the human foot and another between of the body..† is incorrect information. Lastly in that sentence to prove the point the author is trying to get across he also adds â€Å"enabling your soles to heal your entire body as you walk† . With this entire paragraph put the way it is so sarcastically it allows the readers to see how foolish they are when they don’t see past the improper evidence the marketers give off.Moving into the fourth paragraph, which still contains the same purpose as the second paragraph, the authors use paradox to get the claim across to the audience. Such as â€Å" MagnaSoles utilize the healing power of crystals to restimulate dead foot cells with vibrational biofeedback..† The author uses this paradox to show the MagnaSoles â€Å"appearance of usefulness†. As the  satire continues the authors continue to use mocking fiction words such as â€Å"pseudoscience†, â€Å"terranometry†, and â€Å"pseudoscientists†.The authors add in sarcasm in lines 35-38 to help the audience visualize the â€Å"top† science that are issued for advertisements are most likely fakes. Such as â€Å"..developed specially for intergraded products by some of the nation’s top pseudoscientists† . starting line 39 another fictional word is added in to help the purpose of mocking the ordeal methods used by marketers to sell products to consumers, and the word is â€Å"Terranometry† which is the mockly said to be discovered by Dr. Frankel who â€Å"Discovered† Terranomtry.This sets up imagery for the audience to see how the Fake scientists â€Å"discovered† the research for the prod uct and â€Å"Developed the research† for the products in real life are just lying their way through the marketing agencies and the consumers.Lines 43-45 gives off more untruthful information that the writers purposely wrote to help the readers gain more of an understanding that the commercials and advertisements they see day to day have non trustworthy information on them in order to sell better because of the desire for greed. The authors write â€Å"if the frequency of one’s foot is out of alignment with the earth, the entire body will suffer† this helps the author’s claim that they are trying to make. Throughout this paragraph unrealistic diction choices such as â€Å"terranometry† and â€Å"kilofrankels† are used to let the reader see the marketer’s desire for money is so strong that they are willing to lie their way into consumers mind to get a sale.Moving into the final section of the piece the authors use Testimony of authorit y and sarcasm to help the reader see the stupidity of the consumers and to finalize the logic that the science to develop most inventions are false, the need is false, and the product is false. The authors add in a sarcastic quote â€Å"I twisted by ankle something awful†¦ but after wearing MagnaSoles for seven weeks, ive noticed a significant decrease in pain..†This allows the audience to indicate the logic of the consumers gets mentally disrupted by the customers thinking the â€Å"product† healed them when in all truth it was nature. It pushes the reader to understand that when they see a smart looking man advertising a product that they are hypnotized into thinking that the product is useful and effective when it could just as well be junk and fake.Another Rhetorical device the writers use is  Testimony to authority, and the authors use is a quote from a back-pain suffer saying â€Å" why should I pay thousands for therapy when I can pay 20$ for insoles cle arly endorsed by an Intelligent looking man in a white lab coat† This once again lets the readers see how consumers think so little as to what the product actually is and will buy anything as long as the man looks smart or is â€Å"an intelligent looking man in a white lab coat†.The authors try getting the audience to see that the appearance of the man on the advertisement doesn’t mean the product is correct. You can dress up the appearance of a teacher, but the info they say will still be the same. The authors are trying to be paradoxical to try to argue with the illogical audience to have them change views of their own logic, and to not be having faith in unbelievable foolishness.

I personally believe that all of these need to take a part in becoming an adult. Not everyone becomes an adult, some people just chose to stay children there entire life and it is quite sad and pathetic in my opinion. To be an adult you need to be able to function properly on your own with no help what so ever. Age takes a big part in becoming an adult, you have to be a certain age in order to even experience some things it take to even take the steps to becoming an adult. You need to hit the fifteen milestone in order to start working, and then the sixteen milestone in order to start driving. After that come the â€Å"Big one† which is eighteen which some people consider themselves adults at this age. That would be incorrect, at the age of eighteen the best you can be is a young adult. In my opinion, until you reach the twenty-five milestone and there are no restric tions as to what you can and cannot do, only then can you attempt to be a complete and full adult. Sometimes people get thrown into the world of adulthood through experiences. wether it be traumatic or not this can cause you to start thinking and acting more mature than intended. This can be seen through, say a person losing a parent, this could cause that person to try and take over the role that was just lost. Now this doesn’t technically make you an adult but it is on the right road to becoming a proper adult despite what caused them to get to this position. This sets them up to know how to support themselves on there own when needed and start preparing for the future. Now in my opinion the most important part of being an adult is the responsibilities. What he is saying here is that the colonialists’ left a legacy of greed to the people they enslaved and made wealth and riches more important thatn their own lives. Jay Z who is another black rapper says in his song ’99 problems’ â€Å"half a million for bail cos’ I'm African†. This suggess that jay Z’s views are that because he is not of a white ethnic background, the government, officials will demand a bail payment that is proportionately higher and again this refers back to slavery when human traffic was currency. Each sterling note, although having the same format as the other notes, has considerably noticeable characteristics. The National Database of Nursing Quality Indicators [NDNQI] is the only national nursing database that provides quarterly and annual reporting of structure, process, and outcome indicators to evaluate nursing care at the unit level (Montolvo, 2007). Nursings foundational principles and guidelines identify that as a profession, nursing has a responsibility to measure, evaluate, and improve practice (Montolvo, 2007). The purpose of this paper is to analyze the ‘mislabeled specimen’ indicator for an inpatient rehab unit and devise an action plan based on best practices to decrease the incidence of mislabeled specimens. Analysis of the data According to Dock, (2005) accurate specimen identification is a challenge in all hospitals and medical facilities. Ensuring that specimens are correctly identified at the point of collection is essential for accurate diagnostic information (Dock, 2005). A mislabeled specimen can lead to devastating consequences for a patient (Dock, 2005). Specimen misidentification can be serious, resulting in misdiagnosis and mistreatment (Dock, 2005). For the second quarter of FY09, the rehab unit met their target of zero mislabeled specimens. The third quarter yielded two actual mislabeled specimens with a variance of two. The fourth quarter actual was one with a variance of one. The first quarter FY10 showed an actual of one and variance of one. For the FY09 the rehab had a total of four mislabeled specimens. This indicator was chosen because of the magnitude of this medical error. Nurses, administrators and laboratory personnel must collaborate and create ways to decrease the mislabeling of spec imens. Nursing plan Nursing interventions to decrease the number of mislabeled specimens and improve actual indicator scores are: 1) Ensuring proper identification of patient 2) The use of electronic technology and 3) Bedside labeling. Each of these interventions will positively impact patient outcomes and reduce errors. According to The Joint Commission [TJC], proper patient identification is best practice for decreasing mislabeled specimens (The Joint Commission as cited by Sims, 2010). National Patient Safety Goal [NPSG], 01.01.01 states that healthcare providers should use at least two identifiers to identify patients. For example, the patient’s full name and date of birth is used to properly identify a patient (The Joint Commission, 2014). Brown et al (2011), found that the clinical applications of electronic and information technology support can assist in the identification, control, and reduction of error rates throughout the process. According to the World Health Organization [WHO] healthcare providers should encourage the labeling containers used for blood and other specimens in the presence of the patient (World Health Organization, 2007). This would suggest labeling specimens at the patient’s bedside or before leaving the room. Nurses should never label specimens before collection as this could lead to serious errors. Summary In summary, NDNQI indicators serve as a schoolmaster that holds nursing accountable to practice. An analysis of ‘mislabeled specimens’, found that an inpatient unit had a total of four incidents for FY09. While this does not seem like a great deal of errors, any one error could have detrimental consequences. These officers also deal with issues regarding money, security, health care and the general welfare of inmates. Correctional management has a wide range of issues and implementations in Americas criminal justice system. The initial and principal part of correctional management involves issues concerning the safety and security of offenders and its staff. In General, the management within these institutions has to declare what it deems to be safe versus what is not. Formulation of rules and policies occurs every other time an ugly incident occurs, immediately changing existing policies. Correctional administration may put into operation policies that may make the survival of inmates to be almost unbearable. Another element of correctional administration is health care, which at times can be very controversial and pose many compilations. Within a prison setting, officers have the responsibility of ensuring that all offenders receive proper medical attention. Some prisons around the country have their own medical facilities as others get charged fees to take their prisoners to a hospital. One of the most important concerns of correctional administration is rehabilitation. Rehabilitation is a broad subject that faces rehabilitating habitual offenders, drug users as well as other offenders with mental issues. Correctional institutions in collaboration operate these rehabilitation programs with the professional assistance of doctors, psychologists, psychiatrists and other additional medical staff. Everyday, different issues arise within the correctional system, but it is how and where the correctional administration either implements new programs, makes changes to correct controversial issue s or plans to do that matters. Correctional units operate independently with their own administration, budget, committees, assets and support staff. Education and work programs are the two most widely used prison-based forms of correctional programs in American prisons for both adult and juvenile offenders (Ira J. Silverman, 1996). Undoubtedly, the dominance of these treatment programs reveal the steadfast belief that work and educational skills-and the good behavior learned in attaining these skills-are essential to get employment opportunities and also being an industrious citizen. These programs do have a reserved impact in the reduction of post release recidivism according to research carried out Inmates also have access to other forms of education like life-skills training. Prisons maintain these educational programs in the belief that upon release to society, many offenders may not have the sort of basic understanding that is essential to functioning in the American society. Thus, these courses teach diverse skills on how to manage ones finances and property, how to apply and interview for a job, good parenting, securing a drivers license and how to live healthy lives. As a final move in preparing inmates for employment after release from correctional facilities, several prisons offer vocational education. Besides these educational programs that attempt to equip inmates with the necessary skills to live productively in society, other correctional facilities institute counseling/psychological programs aimed at changing the underlying problems that led to the offenders criminality. The most common interventions under this system are drug abuse programs, since according to the records, as many as half of all incarcerated criminals enter prison having at least done drugs a few months prior to their arrest. About half of the prison inmates in both state and federal prisons confess to being on drugs at the time of their crime, for which they were consequently jailed (Maguire, Pastore, Greenfield, 2005). Other institutions have some programs called therapeutic communities-in which they house drug-addicted inmates in separate housing units-referred to as Residential Substance Abuse Treatment, which provides drug treatment to such inmates in the separate units. While in other facilities, inmat es participate in individual or group counseling sessions, but happen to live in the general offender population. Correctional facilities normally provide individual and group counseling, aimed at luring inmates into forfeiting their criminal lifestyle. Cognitive-behavioral treatment modality, a technique of growing appeal is widely used due to its growing support for its successes (David Lester, 2009). Despite coming in different forms, these treatment plans target the criminal attitudes and unlawful ways of thinking which encourage unlawful behavior. This intervention involves counselors acting as role models in an effort to reinforce inmates who portray such conduct. Juveniles get privileges for conforming to set standards. Counselors mainly focus on the aspect of offenders thinking and reasoning by challenging rationalizations encouraging criminal conduct, offenders antisocial behavior, failure to face the mistakes they have committed and trying to externalize blame (D.A. Andrews, 2007). Other groups of inmates who get special services in prison are sex and mentally ill offenders. Commonly, sex offenders receive counseling services at both the individual and group levels. Other special services for sex offenders are diagnostic centers and use of therapeutic communities. While for the mentally ill offenders most receive therapy and counseling while in prison, some are on a prescribed medication, whereas others receive treatment in mental institutions. Another form of correctional programs in these prisons is religious volunteer groups and prison chaplains whose main role is providing counseling to inmates. This type of counseling often goes beyond religious matters and to other issues in the offenders lives. There are various types of faith-based programs found within almost every correctional institution. These support and religious programs involve prayer and meditation sessions, Bible study, worship services and peer mentors (Cullen, 2001). As a common practice, management of inmates is through unit management and direct supervision. These methods create a more secure and safer environment for the staff and inmates, by offering proactive monitoring and built-in surveillance. Unit management divides a correctional facility into smaller and easily manageable housing units. Responsibility and authority is decentralized, which provides the staff with an opportunity to solve directly problems. Correctional officers follow the Corrections Corporation of America philosophy of walking and talking, which involves the officers spending time with and among the inmates, rather than distantly monitoring them or occasionally watching their housing units listening to their needs and making a follow up on inmates concerns so as to quell incidents and disputes before they arise. Through unit management, the facilitys staff becomes aware of collective and individual inmate behavior owing to the direct contact and interaction with the in mates. The officers get to identify behavioral changes among the inmates long before they negatively affect the facilitys security. Use of unit management enables officers to get first-hand insight on inmate activities, ensuring effective monitoring of inmates. Alongside unit management, correctional facilities also use direct supervision to manage inmates with correctional officers housed within the inmate housing units. This enables them to become familiar with a units inmates and their daily operations, communication styles they use and other relevant issues regarding inmates housed there. These officers set and reinforce expectations for inmate behavior and instantly address arising issues at the forefront level. This direct interaction between inmates and officers promotes communication, reduces tension and suppresses possible conflicts between the two groups. Direct supervision Fosters staff collaboration, as unit managers, correctional officers, correctional counselors and case managers handle everyday matters concerning safety and security, inmate cases and sanitation, which helps in streamlining operations in the facilities. When used together, direct supervision and unit management offer important opportunities to create a safer, more secure inmate environment, enhancing facility operations and in providing employees with expanded operational tasks. Inmates and staff interact on a more dependable basis, which enhances effective communication between the two groups. The modern private prison business emerged when the Corrections Corporation of America got a contract to take over a facility in Tennessee. This was the first time that any government had outsourced the complete operation of a prison to a private operator. As of today, private companies in the United States run 264 correctional centres, housing almost 100,000 adult criminals. Prison privatization has several advantages, which have led to the immense growth of private prisons. Private prisons as compared to state prisons are more responsible and accountable due to fear of fines. According to a research conducted on the cost/benefit analysis, results indicated that states could save a considerable amount of cash if they used a shared system of both publicly and privately managed prisons. By using the private sector to manage or build prisons, many states believe they can reduce operational costs. Cost comparisons between government and private operation of prisons shows notable cost savings under private administration. While the average cost to hold a prisoner in a state prison is about $40 a day per inmate, many private prisons charge the government considerably lower fees for the same. By contracting out prison labor and paying the prisoners competitive wages, many private firms are reducing prison costs for the state by withholding income earned for taxes, victims compensation and family support. Such employment also provides prisoners with skills and work experience that prepares them for the job market when released from incarceration (Tewksbury, 2006). Various states consider private construction of prisons as a promising solution to the overcrowding crisis in state prisons. Normally, states finance construction of prisons by issuing general obligation bonds or through cash appropriations. The former creates problems, as it requires voters ratification and control by debt limits, while the latter completely lays the financial load of constructing on the states annual budget. The only alternative is private financing through lease agreements or lease purchasing contracts. This option does not require voter approval neither does it place the costs involved on the annual budget. Under a lease/purchase contract, private firms agree to build a prison only if the state signs a long-term lease for the prison. Prompt payments of rent by the government assist the private companies to fund the construction. When the state fully settles the payment, the debt and finance charges, it takes over control of the facility. The private firms benefit from tax waivers and cash inflow from the lease payments. The state benefits from the quick construction, as debt limit limitations do not apply and voter support is not a requirement (Tewksbury, 2006). Privatization of prisons ensures that only those service providers who offer quality products at a competitive market price will survive the operations of a free market. This aspect of privatization argues that a free market introduces efficiency and discipline through the mechanisms of demand and supply. As more criticisms towards prison privatization become evident, it is obvious that rehabilitation of prisoners is not a concern of the influential, since prisoners in private prisons act as cheap labour. The individuals who own private prisons not only make huge returns from the funds provided by the government to run these prisons, but also make great profits from selling the labour provided by their prisoners. Under the disguise of saving taxpayers money, the trend of privatising prisons has gained momentum, whereas the drawbacks of private prisons are hushed-up. Privatization of prisons is one of the countless ways in which the rich exploit people without their utter knowledge, for their own hidden motives by the public. Private prisons have brought about a huge political and sociological change that most people ignore. Living conditions in the prisons have deteriorated and it is evident that abuse of human rights is becoming rather rampant in these prisons as rising abortion rates, rape, use of psychotropic drugs and failing health care systems become known. It is obviously certain that it is in the interests of private prisons to operate for stricter legislation, so that prisoners stay incarcerated for as long as possible. Yet Doctorow also points out that with the success or attempted success of the American dream, one must make sacrifices, compromising morality, physical well-being, conscience, or identity. The overall benefits, though, of achieving prosperity, equality, or acceptance seem to always outweigh the adverse affects that result from chasing the enduring dream.      Ã‚  Ã‚   In his most acclaimed novel to date, Doctorow tells a "story of the intersection of three very different families"(Weiss n. pag.) during the gilded era of the 1910's. Titled after the ubiquitous music of the decade, Ragtime chronicles the clashing social, economic, and political ideas that plagued the beginning of the century. Gender Equality and Environmental Sustainability in Uganda’s Water Sector

GENDER EQUALITY AND ENVIRONMENTAL SUSTAINABILITY IN UGANDA’S WATER SECTOR. By Nandala Mike([email  protected] com) 1. 0INTRODUCTION 1. 1Essence of Gender, Gender Equality and the Environment Gender refers to the different roles, rights and responsibilities of men and women and the relationships between them, their qualities, behaviours, and identities which are determined through the process of socialisation to define their relationships with each other and with their environment.Gender equality on the other hand is a principle that equates men and women before and under the law; men and women have equal dignity (worthiness); and have equal opportunities in economic, political, cultural and social life. It is upon this background that the relationships and rights enjoyed by men and women foster decision making and activities that in turn have been affected in both the management and sustainability of the environment. It has been observed that there is an undesirable imbalanc e that has existed between men and women resulting in inadequate performance of the letter of their roles.Often this has slowed down development initiatives leading to adverse effects on the environment. 1. 2 Significancy of Water in Social and Economic Development Water is a key strategic resource, vital for sustaining life, promoting development and maintaining the environment. Access to clean and safe water and improved sanitation facilities and practices are pre-requisites to a health/population and therefore have a direct impact on the quality of life and productivity of the population.Besides domestic water supply, water is also vital for: Livestock Water Supply, Industrial Water Supply, Hydropower generation, Agriculture, Marine Transport, Fisheries, Waste Discharge, Tourism, and Environmental Conservation. Water, therefore, significantly contributes to the national socio-economic development and also poverty eradication (UNWD, 2005) Water is thus an integral part of the natu ral resources protected under the Uganda Constitution. 1. 3Government Committement.Over the last two decades, government has committed itself to the implementation of public sector reforms meant to ensure sustainable development, through legislative and policy frameworks anchored on three key policies, namely: Decentralisation, Privatisation and Divestiture; and the Poverty Eradication Action Plan (PEAP), These were intended to reduce the burden of the nation’s concern for income generating resources and practices. The PEAP was prepared in 1997 in a move to eradicate poverty as an overall national planning framework.It has since been revised through 2007/8 and based on five pillars, namely; (1) Economic management; (2) Enhancing production, competitiveness and incomes; (3) Security, conflict-resolution and disaster management; (4) Good governance and (5) Human development (PEAP 2004/5-2007/8) Water and sanitation are some of the central elements under pillar one intended to i mprove the quality of life of the poor through human development. The second pillar points out a strategy to foster production, incomes and competitiveness through water consumption and production.It also addresses actions to empower and strengthen women’s gender awareness and furthermore points out inadequacies aimed at capacity building in the application of skills, limited choice in the decisions about the nature of services received and needed by women, less efforts in community gender awareness campaigns, weaknesses among decision makers including support in supervision and monitoring thus leading to reasons for low gender responsiveness in the water sector. Which way forward?With this background, this Article addresses key policy and legal frame works in the water sector, gender and environmental impact assessment of water resources which have been developed and supported by various laws, sector performance, integration of gender into environment and sustainable develop ment, issues of particular concern, and recommendations. 2. 0Policy, Legal and Institutional Frameworks 2. 1Policy The policy objectives of the Government of Uganda for the Water and Sanitation sector are at two levels: first, the domestic consumption and secondly, water for production.At the domestic level, the objective is to provide sustainable safe water and hygienic sanitation facilities, within easy reach, based on management responsibility and ownership by users, to 77% of the population in rural areas and 100% in urban areas by year 2015. Concerning water for production, the aim is to promote development of water supply for agricultural production in order to modernise agriculture and mitigate effects of climatic variations on rain fed agriculture (MWLE, 1999).In essence, the overall policy objective is to manage and develop the water resources of Uganda in an integrated and sustainable manner, so as to secure and provide adequate quantity and quality of water for all social and economic needs of the present and future generations. The Government aims at full participation of all stakeholders with an 80-90% target for effective use and functionality of facilities. Other policy measures have also been put in place by the Environment and Natural Resources Sector Working Group which commissioned a study on the use of economic instruments for environmental management.Curbing water pollution was a key implementation factor for environmental sustainability. In 1998, the government introduced a water waste discharge fee ranging from 0 to 13 million Ugandan shillings ($0 to $7,000) in proportion to the biological oxygen demand load. The fees were meant to encourage investment in less polluting technologies. The legislation required that companies register for discharge permits before dumping industrial waste water. 2. 2Legal FrameworkThe major Instruments relevant to the Water Sector that provide the enabling legal framework for the water resources management and development in Uganda include: the Constitution, which provides the broad legal and policy framework within which all water sector legislation, policies and development plans are developed; the National Environment Act,(1995), it provides the framework for coordinated and sound management of the environment including environmental impact assessment of water resources related projects and setting water quality and effluent standards; the Local Government Act, which provides for the decentralisation of functions, powers, responsibilities and services to Local Governments; Uganda Water Action Plan (1995); the Water Resources Regulations and Waste Water Discharge Regulations (1998), providing for the regulation of water abstraction and waste water discharge through the use of permits; the National Water Policy (1999), indicating the policy framework for water resources management and development in Uganda. Other related legal policies include the National Gender Policy (1997) ; Plan for Modernisation of Agriculture (PMA) and ; Water and Sanitation Gender Strategy (2003-2008). The policies and legal framework outlined above, are forward-looking in intention, for socio-economic, development strategies of the Government of Uganda and have supported various reforms in the water sector which has enabled government, to put in good order and rationalise the country’s resource utilisation. The question is, are these policies fully implemented? What is the implementation stand at local government and community levels?There are challenges regarding definition of roles and responsibilities, capacity and coordination of men and women, as well as collaboration for improved performance especially at government and community levels (MWLE, 2005). There is also need to review some provisions of the laws to incorporate regulatory functions and allow equal participation of men and women, in the water sector. (1)Institutional and Implementation Framework The water sector i s structured at three distinct levels namely: (a) the national, (b) decentralised or local government level and (c) the micro or user level. (a)National level At the national level, a Ministry of Water, Lands and Environment (MWLE) was created in 1996 following Government restructuring of line Ministries.This institution is charged with overall responsibility for initiating national policies and setting national standards and priorities for water development and management. Two national institutions are under this Ministry: The National Water and Sewerage Corporation (NWSC) and Directorate of Water Development (DWD). At implementation level, the Water and Sanitation Sector Working Group (WSSWG) which is under the Ministry of Water and Environment (MWE) provides policy and technical guidance for sector development in the country; approves all sector programmes, including work-plans and budgets. The sector comprises representatives from ; Development Partners and Non-Governmental Orga nisations and Government.The National Water and Sewerage Corporation (NWSC), was established in 1972 with responsibility to deliver water supply and sewerage services in 15 urban centres serving 2. 1 million people. These centres are Entebbe, Kampala, Jinja /Njeru, Mbale, Tororo, Soroti, Gulu, Lira, Arua, Masaka, Mbarara, Fort Portal, Kasese, Bushenyi/Ishaka and Kabale. The Directorate of Water Development is the leading water sector agency responsible for policy guidance, setting standards, co-ordinating and monitoring, sector reporting, and undertaking sector relevant research and development. DWD is also responsible for managing water resources including provision of oversight and support services to the local governments and other water supply service providers. DWD, 1991-2001 ) Other national level institutions that play important roles in the Water and Sanitation sector include Ministry of Finance, Planning and Economic Development (MFPED), responsible for the mobilisation and allocation of financial resources including co-ordination of donor inputs and the privatization process; Ministry of Health (MOH), for promotion of hygiene and household sanitation; Ministry of Education and Sports(MoE), charged with promotion of sanitation and hygiene education in schools; Ministry of Agriculture, Animal industry and Fisheries (MAAIF), responsible for planning, coordination and implementation of all agriculture development in the country including irrigation development, aquaculture, and livestock development ; Ministry of Gender and Social Development, which addresses gender responsive development and community mobilisation; and NGOs working in the sector. (b)District level The District and Local Government levels as a whole, are responsible for the provision and management of water and sanitation services in rural areas and urban areas outside the jurisdiction of NWSC, in liaison with DWD. Their functions, responsibilities and powers differ according to the degr ee of decentralization so far implemented for both rural and urban water. Planning, implementation and operational management of water and sanitation activities in major towns remain the function of NWSC. However, of 143 small towns with a population of 1. million, 66 have been gazette as water supply areas, 61 of these have operational piped water supplies and schemes, of which 57 are managed by private sector water operators. Planning and implementation for water supply systems in small towns is still centralized at national level (MWLE 2005). Operation and maintenance is decentralised to the urban authorities and private operators through public-private partnership arrangements. The district water offices operate within the overall framework of the district local councils. The district offices are staffed with a multi- skilled team, in planning, hygiene education and social aspects. The district water team reports to the Works and Technical/Services sub-committees of their respec tive local governments.At county level, technical officers have been posted to facilitate planning and supervision of construction works and overseeing maintenance of installed supplies. The communities are responsible for demanding for, planning, operating and maintaining water and sanitation facilities. (c)The Micro or User level At sub-county level, planning, implementation and operation and maintenance of the rural water and sanitation facilities are organised. These communities are also obliged to pay for urban water and sanitation services provided by NWSC and other service providers. Development of low-cost technology options such as springs, shallow wells, rainwater-harvesting tanks and school latrines are undertaken.The district water office and national level technical teams support the sub-counties to carry out water resources assessment to identify potential areas for water development and sanitation services. The sub-counties assess the demand for water and sanitation s ervices by the communities. This is based on population size and location and functionality of the existing facilities. At community level, the citizens are supposed to participate in the planning, financing, implementation, monitoring and control of community water and sanitation development. Communities submit requests/applications to the sub county for support towards water improvements. These are then forwarded to the district However, the level of community participation is less than the partnership, which it is meant to be.Women who are majority users of Water resources constitute only a handful of people, dominated by men in accessing and managing these resources. The initial programme design and implementation under many previous projects does not fully address gender equity participation. 3. 0Integration of gender into Environment and sustainable development in the water sector In order to avert the rapid degradation of the environment, Uganda developed a National Environme nt Action Plan (NEAP), 1995, that adapted a gender approach in planning the long-term investment of managing the natural resources in the country. The NEAP makes a strong commitment to addressing environment problems and to sustainable development in a comprehensive manner.The plan also argues for participatory approaches to environmental planning and the integration of gender analysis. The Uganda National Environment Management Authority (NEMA) is charged with formulating national environment policies and providing guidance in the implementation, including environment impact assessment, and environment education and training in environment management. The main purpose of incorporating gender in the environment management policies was to enable men and women perform their duties in the best cost effective methods which will conserve the environment, accelerate sustainable development that would improve people’s way of living.To achieve the above objectives there was need to f ormulate activities, which would contribute to the integrated promotion of sustainable livelihoods and environmental protection, covering various sectoral interventions involving a range of actors, from decentralised or local government level to lower levels, that are essential at every stage especially at the grassroots levels in the rural areas with special emphasis on the disadvantaged groups like women and youths. 4. 0ISSUES OF PARTICULAR CONCERN 4. 1Equitable access to water supply Access to safe drinking water is a basic human right and essential for achieving gender equality and sustainable development. Most households, especially at community levels do not have adequate access to water and the children and especially women, walk long distances to fetch water for domestic use.Water near the home contribute significant improvements in nutrition and health. The carrying of water over long distances is a health hazard. During daily water collection, women and girls face the risk of rape and injuries from attacks. A major issue associated with poor water supply and sanitation is a case with the Internally Displaced Persons(IDPs) camps, in Northern Uganda which involves high risks of sexual violence and abuses committed primarily against women and girls, a danger often caused by insufficient water supply and sanitation facilities within the camps which prompt movements to get water from far areas and at homes poor hygienic conditions.Over crowding, poor water pressure and broken water pumps accelerate the crisis (Diane Paul, 2006) Access to fresh water and sanitation therefore, does not only improve the health of a family, but it also provides an opportunity for girls to go to school, and for women to use their time more productively than in fetching water. Women in most cases are primarily responsible for the use and management of water resources, sanitation and health at the household level. Over the years, women have accumulated an impressive store of env ironmental wisdom, being the ones to find water, to educate children in hygiene matters and to understand the impact of poor sanitation on health and the environment.Very often the decision about location of water sources, types of water sources, and who will maintain the operation of the facilities are made without consulting women resulting in no-one taking responsibility. Men, who mainly dominate the operations and maintenance of facilities in the water sector often do not fully implement decisions and actions thus the need to involve more women. 4. 2Equitable access to land rights and water for productive use Equitable access to water for productive use empowers women and addresses the root causes of gender inequality. Lack of access (ownership) to land, is seen as an underlying cause of women’s limited access to water.In Uganda, women technically have little control and ownership on land under customary law in many of the Uganda ethnic societies statutory (national) law, there is, however, no discrimination. According to MFPED (2006), women own only 7% of the registered land in Uganda, a situation which affects gender mainstreaming in the Water sector, as women lack control over resources and therefore have limited decision making over issues like the silting of water sources, maintenance of broken pumps/taps/damaged bore holes/ water tanks and use of water for production. Land ownership is a precondition for access to water. Thus, land reforms that allocated legal land tenure to the heads of households or permanent agricultural workers (who are generally male) resulted in women losing any legal claim to water.There is need of water for a range of small scale economic enterprises, like: home gardens in peri-urban areas ; growing fruits; poultry farming; preparing food, (which are some times overlooked in agricultural statistics). Overall, the Food and Agriculture Organisation (FAO) reports an increasing â€Å"feminisation of agriculture† due to wars, pandemics and the exodus of men seeking paid work in urban areas. Also mentioned is the fact that women are heads of an increasing number of rural households in the developing world and find themselves in the position of managing farm land and providing for their families alone, without legal rights to water and land. 4. 3Equity and Participation in the management of resources in the water sector The management of water resources has been mainly male dominated.Men occupy a bigger portion in careers and training in water management than do women. Social barriers tend to restrict women’s participation in public consultations that can influence policies on water at all levels of water management. This prevents women voices from being effectively heard, particularly with respect to their environmental concerns and also results to limited effectiveness of water, sanitation and hygiene promotion efforts . Usually it is men who make the decisions over water management and sanitation issues and yet it is women who are usually in greater need for sanitation privacy and responsible for water, sanitation and hygiene.It is worth noting that the process of formulating the Water and Sanitation Sub-Sector Strategy (2010/11-2014/15), which began in 2003-2008 (Water Sector Gender Strategy-WSGS,WSGS ), served as the first strategic framework for implementing Uganda’s National Gender Strategy within the powers of the Ministry of Water and Environment (MWE). The WSGS I was developed in response to the various international commitments made by the Government of Uganda regarding gender equality and the National Gender Policy (1997). The strategy was aimed at developing and empowering approaches that would enhance gender equity, participation and access to and control of resources in the water sector.The strategy further put emphasis on both internal and external gender mainstreaming including building capacity for gender planning, monitoring and evaluation; strengthening the capacities of partners and executing bodies for mainstreaming; and committing adequate resources for gender related activities. This is an outstanding move with good intentions of formulating gender equity and participation but unless the Ministry of Water and Environment comprehensively and consistently puts focus on gender concerns, gender mainstreaming in the water sector will not penetrate deeply into matters of policy and legislation. 4. 4Issues on Sanitation Sanitation refers to the drainage and disposal of sewage. The need to dispose human excreta appropriately is an environmental and social concern in the country. Ignoring it posses adverse impacts on environment cost and on health.Lack of sanitation and poor hygiene are responsible for the transmission of diseases such as cholera, typhoid and other parasitic infections. These diseases have a big negative impact on the health and nutrition of communities especially the children. A focus on gender difference s is of particular importance with regard to sanitation facilities which needs the attention of women to play crucial roles in influencing the hygiene behaviours of children, and men too can serve as role models in sustaining changes in disposal habits. Hence the success and effective use of water and sanitation facilities largely depend on the involvement of both women and men in selecting the location and technology of such facilities, and taking responsibility for operation and maintenance.Sanitation concerns are mainly emphasized in urban and peri-urban centres and less priotised in the villages or lower communities/households. It is only under the urban and peri-urban strategies that water is directly linked to sanitation. The number of latrines at community level tend to be less as compared to size of the families needed to access them. Latrines are usually household initiatives sometimes rudimentary in nature. The water sector supply systems are relatively well developed and have mechanisms for delivery whenever necessary as compared to sanitation mostly at community level. There seems to be no well-developed mechanism for sanitation service delivery even at household level. Investment in water supply is highly priotised than sanitation.The reasons why sanitation prioritisation is not key in the water and sanitation sector is because of the difficulty of estimating the sanitation measures especially for rural sanitation where the latrines are merely rudimental with varying degrees of safety which makes it difficult to tag costs of improvements, rehabilitation or construction of such facilities including lack of political commitment to sanitation. It was therefore easy to omit household sanitation and concentrate on institutional sanitation (MWLE 2005). 5. 0Linkages OF GENDER EQUITY with PEAP Goals Gender mainstreaming and improved access to water supply has two potential benefits; improved service delivery and health. Gender equity in the sector offers better services in the management and maintenance while water-born diseases are important issues of the disease burden in Uganda.The sector goals are in line with PEAP goals as well as the Millennium Development Goals(MDGs). For example, the goals aim at the importance of gender in areas of agricultural production, legal discrimination and wood fuel, shortage of sustainable safe water supply and sanitation facilities, based on management responsibility and ownership by the users. It furthermore mentions inadequacies realised in the capacity to apply gender analysis skills, limited gender awareness among the communities, bureaucratic resistance in decision making and weak support in monitoring and supervision of sector activities as the reasons for low gender responsiveness. 6. 0Implementation ChallengesThe Poverty Eradication Action Plan identifies the importance of gender mainstreaming in all interventions which include policy planning, formulation, guiding public actions to eradic ate poverty and points out inadequacies in applying gender analysis skills, limited gender awareness among the communities, bureaucratic resistance among decision makers and weak support in supervision and monitoring. However, the importance of gender equity is not emphasised in the water and sanitation sector major implementation polices. Focus is targeted on poverty alleviation as an overall concern than gender. This limits coverage on gender issues and implementation. The insurgency in some northeast parts of the country and most especially northern Uganda, not only delays implementation, but also contributes to destruction of existing facilities. This contributes to delays in achieving the targets and the goals of the sector and PEAP.Community gender involvement, while it is a good input for environmental sustainability, remains difficult to attain. Attempts have been made to involve the men and women in planning ,maintenance of water and sanitation facilities . The methodologie s require a lot of skills and patience, qualities that are still lacking among the sub-county level civil servants. Women and the youth involvement remains limited as no major efforts have been made to involve them in planning, implementation, monitoring and evaluation. 7. 0The way forward The paper has identified some challenges in transforming the water sector to achieve effective and sustainable services for both men and women.Issues concerning gender and their roles in development process and thus environment have not been given adequate attention by development planners. Women are now viewed as a useful resource to be integrated into development process, thus rendering the projects more efficient and successful. What is the way forward for Uganda to ensure that gender issues are mainstreamed in environment and development plans, projects and actions? 8. 0Issues to be addressed (1)Having water points nearer the homestead will reduce the distance women and girls have to walk, thu s allowing time for other activities, including training, childcare, growing food and income generation.The latter could include construction and management of water and sanitation facilities. (2)It is essential that both women and men be involved in decision making processes regarding the provision, location and technology of water and sanitation facilities in the community and household. (3)Government should also address perceived inequalities between women and men through reviewing laws and policies that discriminate against women and also urge Non Government Organisations(NGOs) and the private sector to champion women’s cause, which might increase women access to land and more decision-making powers. (4)Women groups should be accorded recognition as citizens, land holders and contributors to the development process.They need to have secure access to land and water for domestic use, in addition to productive use in farming including small scale industries. (5)Incorporate g ender analysis into all development plans, projects and actions, by encouraging the development of new skills and expertise within an Integrated Water Resources Management framework, linking social and gender aspects with the ecological, technical and economic dimensions of water management with special attention at community level. (6)The water sector should change the attitude of value system in favour of only men, and develop positive perceptions about women as competent professionals just like their male counterparts. 7)Capacity building for all women should be geared towards effective participation in local governances and sustainable development. Women politicians should be strengthened to enable them represent women interests regarding water and sanitation management and maintenance. (8)The water sector should fill all established posts equitably for better performance. It has been found that projects in which women and men have an equal say have a better chance for sustainab ility and success because they cater for the needs of every one. (9)The legislation on industrial water discharge permits be amended to require all companies / major water polluters to register for discharge permits. 10)A specific percentage of investment in water supply should be dedicated to promotion of sanitation and hygiene initiatives for the welfare of the users and protection of the environment. 9. 0Conclusion The water and sanitation sector has developed elaborate mechanisms and capacity at national, district and community levels for planning and managing sector activities which includes gender and environment issues to a large extent. However, in order to address strategic gender needs, there is a need to introduce fundamental changes in ideologies and power structures, behavioral attitudes, in government, organisations, companies and involve individuals both men and women.

Federal programs Essay

Throughout the twentieth century, Congress has established a great number of federal programs administered by agencies within the Executive Branch. Through this process of a wide-ranging allocation of authority to the executive Branch, Congress has assisted in creating a massive Federal Bureaucracy. The relationship of Congress to the Executive Branch today must therefore be seen in terms of its relation to this Bureaucracy, as well as its relation to the Presidency. In order to gain some control over the operations of the various agencies which had been established within the Executive Branch, in 1946 congress began to develop a sequence of configurations and procedures designed to manage the Administration. This process was also known as congressional oversight. There are several methods through which congressional misunderstanding operations take place: the committee process, congressional administrative offices, casework, as well as a number of administrative practices. Where the congressional oversight functions take place, there are three types of committees: authorizations committees, appropriations committees, and governmental operations committees. The first type of committee is the functional committee which initially establishes or authorizes the program or agency. In the case of a military program, this would be the Armed Services Committees in both chambers. ‘In the case of an urban program, this would be the Banking, Finance and Urban Affairs Committee in the House and the Banking, Housing and Urban Affairs Committee in the Senate. Similarly, each program area within the Federal Bureaucracy is related to at least one specific substantive standing committee in each chamber of Congress. ’ (Issa, 2011) In attempting to follow the oversight activities through these authorization committees, a number of complications are often encountered. One of these is the result from the fact that a particular governmental agency may fall within the authority of several different practical committees or subcommittees. As a result, the agency may play ‘one committee or subcommittee against the other in order to achieve those results in Congress which tend to benefit the agency the most. (Office of The Law Revision Counsel, 2012) Another problem is that a committee which establishes a program is often too involved with the outcome of its own efforts to be willing to investigate adequately the operations of the program it has initiated. One of the most substantial places where an amount of oversight activity takes place is in the appropriations process. The budget for an agency must be approved anew each year. ’ One might assume that this yearly appropriations process would lead to a careful annual inspection of the budgets of all the various governmental agencies. (Issa, 2011) This is not the case. The federal budget is so great and compound that it is impossible to consider carefully the budget of each agency and program on a year-to-year basis. What happens instead is that budgets are often routinely approved from year to year with general reviews only occurring sporadically. In addition, many agencies develop quite close relationships with the subcommittees of the Appropriations Committees which spe cifically deal with their agency. These agencies are therefore often able to abstract some special favors from these particular appropriations subcommittees. The Senate Committee on Governmental Affairs and the House Committee on Governmental Reform were initially established to manage congressional concern over governmental processes. Thus, many see these committees as an ideal place for maintaining congressional observation over the activities of the vast Bureaucracy located within the Executive Branch. However, because of jurisdictional differences and because of the hesitancy of most representatives and senators to provide for satisfactory independent oversight activities, the efforts of these governmental operations committees have been quite restricted. The three administrative offices within Congress are used to some extent in the congressional oversight process. The General Accounting Office, The GAO has the accountability, not simply for performing accounting audits, but also for judging how various programs are being managed. In other words, the GAO often performs the task of program assessment. The GAO plays a significant role in congressional oversight. The Congressional Research Service, while preparing reports and studies to assist members of Congress, the CRS sometimes includes some information on the activities and routines of various governmental agencies. This is another important source of oversight information for members of Congress. The Congressional Budget Office gathers information on the budgets of the various governmental agencies and to report on new budgetary requirements and propositions that are made through the Executive Branch’s Office of Management and Budget. Budgetary information is an extremely important source of data upon which the various congressional committees can judge the effectiveness of specific governmental programs. Granting, the information gathered by the CBO may seem to permit for substantial congressional oversight, the fact is that it is the agencies that often use this informational link for their own purposes in pursuing their requests for additional funding directly to the congressional committee, instead of directing all their communications through the OMB. This short circuits the use of the OMB as one of the President’s management tools. Efficiency, from an overall standpoint, we can see that these three congressional offices. The General Accounting Office, the Congressional Research Services, and the Congressional Budget Office combined with the staffs of individual congresspersons and senators and the staffs of congressional committees are able to supply our national legislators with vast amounts of information and evaluations of governmental activities. ‘In fact, the United States Congress has available to it one of the most extensive research staffs of any national legislature in the world. ’ (Issa, 2011) Nevertheless, the availability of information and study alone is not sufficient for effective congressional oversight. The desire to follow through on this available information is another necessary ingredient and it is this ingredient which is often lacking. Many times congressional oversight is limited by the worries of various congressional committees and subcommittees over their particular jurisdictions and in a substantial number of instances, the burdens of organized special interests also interfere with the ability or wishes of members of Congress to significantly oversee governmental operations. Aside from these problems, there are also the boundaries of time. Congresspersons are loaded with extremely dense schedules. They have a large number of often conflicting responsibilities to perform. Representatives and senators must therefore place priorities on the use of their time. Often oversight activities lose in this shamble of priorities to legislative activities, to the creation of new programs to deal with current problems, and to casework concerns. Representatives and senators, themselves, do not usually become directly involved in much casework or fundamental services. It is their staff that deals with these matters. However, representatives and senators are usually informed by their staffs of many of these problems, and it is through these specific interactions that these legislators often get the most intense impression as to the effectiveness of many governmental programs. Casework thus provides an important source of direct, specific information which proves very useful in congressional oversight activities. Congress has also passed some major reforms and reconnoitered a number of major legislative techniques, many of which have had the effect of enlightening congressional oversight. Sunshine Laws. During the 1970s, Congress attempted to open up many facets of governmental operations to the general public. This was done through the Freedom of Information Act and the â€Å"Government in Sunshine† Act. By making information more broadly available to the public, these acts also increase the amount of information available to Congress. The Congressional Veto. Very often Congress passes rather broad pieces of legislation. It is then up to specific agencies to fill in the details of these laws, both with regard to the building of governmental agencies and the processes which they follow. One might note for example that while Congress passes general tax laws, the details of the regulations regarding the payment of federal taxes is to be found not in the tax law itself but rather in the Internal Revenue Code which is developed by the Internal Revenue Service, which is an executive agency. The problem that were presented by the executive agencies developing a great many regulations or codes is that the only way Congress is able to affect these details is through the passage of new legislative acts. As we have seen, this is often a burdensome and prolonged process. In order to avoid this, Congress now writes into some authorization bills requirements for a congressional veto. According to this procedure, when an agency disseminates rules filling in the details of congressional legislation, Congress automatically has the power within a specific time period to veto some of these rules and to demand that the agency fill in the details in a different way. The important thing is that Congress can do this without having to go through the process of passing a new law. Although this procedure is rarely used, it does offer the prospective for a far greater legislative control over the procedures by which the Bureaucracy operates. Sunset Legislation. In starting governmental programs or agencies, Congress usually sets no time limit on the functioning of the program or agency. Since the 1970s, a practice developed by which Congress authorizes the existence of a program or agency for only a inadequate amount of time. In other words, Congress specifies a date by which the agency or program will conclude to function. In order for the agency to continue its operations after that time, a new bill must be passed allowing its continued existence for another specified period of time. This practice is obviously intended to avert the continued existence of agencies or programs which no longer meet a legitimate need or which fail to meet a legitimate need effectively. A dissimilarity on sunset legislation is the procedure of annual authorization. According to this procedure, the continued existence of governmental agency must be approved on a year-to-year basis. While this practice obviously creates tremendous difficulties in the ability of such an agency to engage in long-term planning, it does suggestively increase the potential effectiveness of congressional control. ‘Zero Based Budgeting (ZBB). Zero Based Budgeting is a technique through which administrators must carefully justify their entire agencies’ budgets. Zero based budgeting requires a continual top-to-bottom assessment of all agencies’ programs designed to insure their cost effectiveness. ’ (Issa, 2011) We can see that many structures and techniques have been developed to allow Congress to be more effective in its oversight activities. However, jurisdictional disputes and pressures from various well organized special interests continue to prevent these new techniques and sources of information from being used effectively. In many occurrences, the actual nature and effect of government policy depends less on the actions of our elected officials than it does on the activities of non-elected bureaucrats who often remain totally immune from the pressures of the general public–although not necessarily from those of well-organized special interests. One of the major political issues determining our national future is the question of how well our government is able to represent effectively the needs and desires of the American people. As we have noted, the role of Congress as a representative of the people was one of the most important functions of this â€Å"first branch† of government envisioned by the Founders when they drafted the Constitution. However, the many new needs which our national government has had to meet in this century have placed this role of representation under great stress.
